Inspectors say animals in distress due to poor water quality.
Ontario's animal welfare watchdog is ordering Marineland to fix its water system.
As reported by The Canadian Press, Animal Welfare Services launched an investigation into the Niagara Falls park earlier this year.
The inspection remains ongoing, but on May 10th, two orders were issued to repair the water system.
Marineland appealed the order on May 18th, denying the animals were suffering.
Park officials also said water issues were not related to the deaths of an unspecified number of whales.
Alanna Goziaman, one of the animal welfare inspectors at the park said in an affidavit that several life supports for mammals at the park were found to be in need of repair, and parts haven't been maintained properly.
A copy of the affidavit was obtained by The Canadian Press, and it indicates that inspectors had ordered the park to replace or repair all broken or malfunctioning devices relating to mammal life support systems.
The park was ordered to meet water quality standards by May 17th.
In an appeal, the park said its marine mammals were under the care of veterinarians, and claimed the inspectors didn't have the know-how to evaluate marine mammals.
Park owners withdrew the case in June.
There is no word on the exact number of whale deaths at the park.
